MOPED USAGE REGULATIONS
INTRODUCTION AND SCOPE OF SERVICES
These Regulations, which are an integral part of the Ridemovi General Terms and Conditions, define the procedures, terms, and obligations for using the shared electric moped rental service offered by Ridemovi. Unless otherwise defined, capitalized terms shall have the same meaning as those given to them in the Ridemovi General Terms and Conditions.
The electric moped service (the “Service”) allows users to rent electric mopeds (the “Vehicle”) in the areas specified in the Application for a per-minute rate or subscription rate. The vehicles, which have no fixed stations, can be booked, used, and returned at any point within the operating area. To access the Service, users need to download the Ridemovi Application for iOS or Android devices.
Users may carry one (1) passenger on the Vehicle, with a maximum permitted total load weight of one hundred and fifty (150 kg) kilograms.
START AND END OF SERVICE
The Service starts when the User activates the “SCAN” option and ends when they activate the “END RIDE” option in the App downloaded to their mobile device. The Vehicle will be considered in use once the User has activated the “START RIDE” option, at which point Ridemovi will begin billing for the Service.
REGISTRATION REQUIREMENTS
To register and use the Service, Users must:
- a) Be at least 18 years old;
- b) Hold a valid driver’s license;
- c) Have a valid identity document;
- d) Own a smartphone compatible with the Application.
Possessing a temporary or limited driver’s license or permit, or reporting a lost or stolen driver’s license, does not allow the User to use, or benefit from, the Service.
REGISTRATION PROCEDURE
If the above requirements have been met, Users may register for free through the Ridemovi App by filling in all mandatory fields in the registration form with accurate, complete, and up-to-date information. The following documents are required:
- a) Payment method authorized by Ridemovi
- b) Valid driver’s license in force
- d) In some cities, Users will also be required to provide an identification document (for example, an identity card, residence permit, or passport).
Before registering, the User will need to confirm that they have read, understood, and accepted the Terms and Conditions by checking the appropriate boxes. Once the request has been filed, Ridemovi will validate the data and accompanying documentation and, if applicable, activate the User’s account to begin using the Service.
Ridemovi reserves the right to verify the data provided and deny registration if the payment method is not accepted. Ridemovi may also cancel the account in the event of contractual breaches, suspected fraud, identity theft, unpaid debts, or pending disputes with the User, as further defined in the Terms and Conditions.
VEHICLE ACCESS AND IGNITION
The User will make sure that the Vehicle’s battery has sufficient power to return the Vehicle to an authorized area by the end of the rental period. Failure to do so will result in liability, in which case the penalties set forth in these Regulations may apply.
Vehicle Use and Safety
- The Vehicles are equipped with two approved helmets, accessible via the App or by pushing a button on the frame/top box (depending on the model).
- Before setting off, check that the helmets are present. If they are missing, immediately report the circumstance via the App.
- It is forbidden to operate the Vehicle without a helmet. Users will also be required to wear their own gloves, as required by law.
- Users are responsible for the proper use of safety equipment and hereby hold Ridemovi harmless from any damages or fines resulting from failure to use such equipment.
Ignition of the Vehicle
- To start the Vehicle:
- Lift the Vehicle off the stand.
- Press the “START” button.
- The display will light up, indicating that the Vehicle is ready.
Pre-Ride Checks
- Check the condition of the Vehicle (brakes, bodywork, wheels, lights, helmets, noise, etc.) before setting off.
- Report any malfunctions via the App before using the Vehicle Breakdown feature.
- In the event of serious malfunctions, do not use the Vehicle.
VEHICLE PARKING
Before starting the ride, Users will be required to check the map of the area provided in the App to verify whether their destination point is within the area authorized by Ridemovi for completing the Service.
VEHICLE LOCKING AND PARKING
- Park the Vehicle correctly and safely, placing it on its stand.
- Avoid obstructing pedestrian areas or road traffic.
- Store helmets and accessories in the top box and lock it properly.
- Upload a photo of the parked Vehicle to the App, making sure the license plate and surroundings are visible.
- End the Service only within the authorized areas indicated in the App.
- It is forbidden to end the ride in private, non-public areas, areas without GPS, or areas where parking is prohibited.
VEHICLE CONDITIONS AND LIABILITIES
- The Vehicle shall be returned clean and in the same condition in which it was picked up.
- Any personal items found shall be reported to Customer Service. Ridemovi is not responsible for forgotten items.
- Any damage to cell phones caused by using the Vehicle’s appropriate holder is not attributable to Ridemovi. Users waive any right to claim damages in such regard.
VEHICLE BREAKDOWNS AND MALFUNCTIONS
Users may report Vehicle breakdowns or malfunctions, if any, via the App using the Vehicle Breakdown feature.
Termination of Service
Users may terminate the Service at any time through their account in the App, in accordance with the Terms and Conditions.
PAYMENT AND BILLING TERMS
Registration as a User of the Application is free. You may view the Rates in the Ridemovi Application, where they are permanently available and updated. Ridemovi also offers the opportunity to take advantage of offers, promotions, and/or discounts, the terms and expiration of which may be communicated to the User and/or viewed in the Application.
OBLIGATIONS OF THE USER
Users are required to use the Service diligently, complying with the Highway Code and local regulations. Specifically:
- Valid driver’s license: Mandatory for vehicles requiring one. It must be valid and not suspended, revoked, or forged.
- Mandatory reporting: Users must report any theft, loss, suspension, or expiration of their driver’s license to Ridemovi.
- Correct parking: Users must comply with local regulations and upload a photo of the parked Vehicle to the Application as proof.
- Personal Account: Registering more than one account or sharing it without authorization is prohibited. Ridemovi may cancel the User’s account and apply penalties.
- Damages and accidents: Users must avoid damage and, in the event of an accident, provide truthful information.
ACCIDENTS
In the event of damage to the Vehicle while using it, Users are required to notify Ridemovi using the notification channels specifically designated for such purpose on the Application (web chat or email). In this case, Ridemovi will charge the User for the related repair expenses or other costs arising from the damage caused, always up to a maximum deductible of €500.00 and provided that such damages or costs are attributable to the User due to improper or negligent use of the service. In the event that the User is found to have held malicious misconduct or committed fraud, the same will be held liable for all damages caused by or to the Vehicle and will be charged all repair costs.
In the event of an accident, the User must promptly contact the Ridemovi Customer Service via the App, describing the accident, the damage to the Vehicle, and the exact location, and submit a completed CAI form (Constatazione Amichevole d’Incidente, accident report form).
The CAI form must be forwarded to support@nullridemovi.com within 48 hours of the event (except in cases of force majeure).
The penalty for failure to report an accident (with or without third parties), failure to submit an accident report when third parties are involved, or providing incomplete accident information within 48 hours of the accident will be €250, without prejudice to any further damages.
Theft, robbery with violence, or vandalism. If the Vehicle used or its accessories are the subject of theft, robbery with violence, or vandalism, Users will be required to contact Ridemovi using the specifically designated notification channels via the Application (web chat or email), file a report with the competent authorities, and send Ridemovi a copy of such report to the specified email address (support@nullridemovi.com) no later than twenty-four (24) hours after reporting the incident to the authorities. In the event of theft or robbery with violence, the User will be required to pay Ridemovi a penalty of €500.00, without prejudice to the User’s right to prove that the incident occurred through no fault of their own.
PENALTIES AND ADMINISTRATIVE VIOLATIONS
When using the Service, Users are required to comply with the Highway Code, local regulations, and municipal regulations, including those specified in the Application. Users will be responsible for the Vehicle for the entire duration of the rental period, including for traffic violations and unauthorized parking.
In the event of violations, Ridemovi may report the User to the authorities and charge fines, expenses, and penalties (see the PENALTIES section below). If the information provided is not up to date and prevents identification, the User will be charged for any costs related thereto.
Before parking, Users are required to check for any temporary restrictions. If the Vehicle is towed away, all costs will be charged to the User. In Italy, administrative seizure carries a specific penalty.
Failure to pay fines or penalties may lead to suspension of service, termination of the contract, debt collection, and reporting of the User to public bodies or credit registers.
The following are some of the conducts (by way of example and not limited to) that are considered serious violations or breaches of contract by the User, without prejudice to the Terms and Conditions:
- a) Not being of the minimum age or not holding a valid driving license to use the Service and the Vehicles that require one.
- b) Failing to notify Ridemovi of the suspension, revocation, withdrawal, loss, or theft of the driving license.
- c) Using false documents or documents not belonging to the User when registering for the Service.
- d) Acting negligently by making multiple bookings for one or more Vehicles without commencing the rental.
- e) Failing to pay any penalties, if applicable, imposed by Ridemovi for improper use of or damage to the Vehicle.
- f) Parking the Vehicle, upon expiration of the rental, outside the return area or in areas not designated for such purpose (including in temporary no-parking zones), as well as in private parking lots or not on public roads.
- g) Reckless driving of the Vehicle.
- h) Defiling, vandalizing, or abandoning the Vehicle in poor condition.
- i) Using the Service under the influence of narcotics, alcohol, or psychotropic substances.
- j) Tampering with, reproducing, cloning, or inappropriately or fraudulently using the Application or its platform.
- k) Allowing a third party other than the User who initiated the ride to drive the Vehicle.
- l) Facilitating or committing acts of vandalism, theft, or robbery with violence in regard of the Vehicle through intent or gross negligence.
RULES FOR VEHICLE USAGE
The Vehicle may only be driven by a User registered for the Service by logging into their account and entering their credentials and password, which are personal and non-transferable.
It is expressly prohibited to loan, rent, sell, or otherwise pledge the Vehicle, grant access to the Ridemovi Application, the Vehicle’s equipment, tools, and/or accessories, and/or any part or component thereof, or use them in a manner that otherwise infringes Ridemovi’s rights.
As a Ridemovi user, you are responsible for completing the trip leaving the vehicle and its accessories in perfect condition and without defiling them. Ridemovi otherwise reserves the right to apply the penalties set forth in the PENALTIES section below.
Users are required to stop the Vehicle as soon as the instrument panel or any warning lights begin to flash, indicating a malfunction while driving. In this case, the User is required to immediately contact the Ridemovi Customer Service through the dedicated channels via the App. Roadside assistance charges will not be accepted unless expressly authorized by Ridemovi.
Transporting the Vehicle on board any other means of transport is prohibited, unless expressly authorized by Ridemovi.
It is mandatory to keep the Vehicle documentation inside the Vehicle at all times.
Users agree not to use, or permit the use of, the Vehicle in the following cases:
- a) Transporting passengers for a fee.
- b) Pushing or towing any vehicle or other object, whether wheeled or otherwise.
- c) Participating in competitions, whether official or not, as well as in endurance tests of materials, accessories, or products.
- d) Driving the vehicle under the influence of alcohol, narcotics, or any other type of intoxicating substance.
- e) Transporting goods in violation of the law or applicable regulations, or for unlawful purposes.
- f) Transporting more passengers than the authorized number specified in the vehicle registration certificate and/or the vehicle’s Technical Inspection form.
- g) Transporting goods exceeding the authorized weight, quantity, or volume specified in the vehicle registration document and/or in the vehicle’s technical registration document.
- h) Transporting flammable and/or hazardous goods, as well as toxic, harmful, and/or radioactive products.
- i) Transporting animals.
GEOLOCATION
All Vehicles are geolocated via GPS and can be located and identified by the User via the Ridemovi App.
When selecting the Vehicle shown on the map, and before pressing the “BOOK” button, the User must check the battery life and verify that it is sufficient to complete the desired route.
VEHICLE THEFT AND DAMAGE
In the event of theft, vandalism, or damage to the Vehicle, Users are required to notify Ridemovi by using the designated channels via the App. Repair costs will be charged to the User within the deductible amount if such damage was the result of misuse or negligence. In the event of fraud or gross negligence, the User will be liable for the full amount of damages. PENALTIES
Users agree that Ridemovi may charge any penalties, up to the maximum amounts specified below, directly using the chosen payment method. Ridemovi may also seek compensation if the damages exceed the following amounts:
- Vehicle value in the event of theft, damage, or loss: €500
- Use of the User’s account and login credentials by unauthorized third parties or parties unrelated to the Service €100
- Driving without identification documents or a valid driving license €150
- Parking the Vehicle in privately-owned areas, restricted access areas, temporary no-parking zones, or not on public roads €250
- Failure to report theft or loss of the Vehicle during the rental period €250
- Parking outside the operating area €50
- Failure to provide a photo, inaccurate photo, or illegal parking €25
- Administrative impoundment (IT) €500
- Dirty Vehicle or any of its accessories €60
- Administrative fine for violating traffic regulations (in addition to the traffic fine) €30
- Compensation for relocation or recovery of the vehicle from storage due to non-compliance with parking regulations €30
- Compensation for non-compliance with the obligation to park the vehicle in the area identified in the Application (geofence) €150
- Forced towing costs: weekdays or daytime €160.00 Holidays or nighttime €190.00
Except as provided for in these Terms and Conditions, in addition to the amounts and grounds for payment set forth above, please note the following: a) Driving under the influence of alcohol or narcotics is punishable by suspension of the User’s account for a period of eight (8) months; b) The penalties specified above will be charged without prejudice to any fines or penalties imposed, as may be charged separately by the Public Administration or bank depending on the nature thereof.
The User declares that, by completing the registration process via the Application and accepting the Regulations, he or she expressly and specifically approves and accepts the following clauses, pursuant to Article 1341 of the Italian Civil Code: VEHICLE CONDITIONS AND LIABILITIES, ACCIDENTS, PENALTIES AND ADMINISTRATIVE VIOLATIONS, VEHICLE THEFT AND DAMAGE, and PENALTIES.
